Court and Lawyer Fees in Germany 2026: RVG and GKG Fee Tables by Amount in Dispute

Reading Time: 12 minutes

In Germany, the cost of a lawsuit depends on the amount in dispute (Streitwert). Court fees are set by the Court Fees Act (Gerichtskostengesetz, GKG), lawyer fees by the Lawyers’ Remuneration Act (Rechtsanwaltsvergütungsgesetz, RVG). Both fee tables were raised on 1 June 2025 and still apply in 2026. An example: with €10,000 in dispute, the basic lawyer fee is €652 and the basic court fee €283. The first instance therefore costs €849 in court fees and around €1,964 per lawyer including VAT. The party that loses pays around €4,776 in total.

This page gives you the complete RVG and GKG fee tables up to 30 million euros, explains the lawyer fees in the RVG fee schedule, shows the cost risk for every instance, and answers who pays in the end. It is written for anyone suing or being sued in Germany, including companies and individuals from abroad.

At a glance

  • Court fees: in the first instance 3.0 times the fee from the GKG table, on appeal 4.0 times, before the Federal Court of Justice 5.0 times.
  • Lawyer fees in a lawsuit: usually 2.5 fees from the RVG table (1.3 procedural fee + 1.2 hearing fee), plus a €20 expenses allowance and 19% VAT.
  • Loser pays: the losing party pays the court, its own lawyer and the other side’s lawyer (§ 91 ZPO).
  • A court settlement cuts the first-instance court fee from 3.0 to 1.0.
  • The litigation cost calculator works out the figures for your own case.

1. RVG and GKG Fee Table 2026: Fees by Amount in Dispute

The table shows the basic fee (1.0) under Annex 2 RVG and Annex 2 GKG. All lawyer and court fees are calculated from it. If your amount in dispute falls between two rows, the next higher row applies: for €8,400 that is the row “up to €9,000”.

All amounts are net. Court fees carry no VAT; 19% VAT is added to lawyer fees.

How the values are calculated

Both tables rise in steps. Up to €500, the court fee is €40 and the lawyer fee €51.50. A fixed amount is added for every further step that is started:

Amount in dispute up to per started step of Increase GKG Increase RVG
€2,000 €500 €21.00 €41.50
€10,000 €1,000 €22.50 €59.50
€25,000 €3,000 €30.50 €55.00
€50,000 €5,000 €40.50 €86.00
€200,000 €15,000 €140.00 €99.50
€500,000 €30,000 €210.00 €140.00
over €500,000 €50,000 €210.00 €175.00

Amounts in dispute over 500,000 euros

Above €500,000, the court fee rises by €210 and the lawyer fee by €175 for every started €50,000. The amount in dispute is capped at 30 million euros (§ 39(2) GKG, § 22(2) RVG); fees do not rise beyond that.

2. German Court Fees (GKG) per Instance

In civil proceedings, each instance carries one flat court fee. It covers the whole proceedings, however many hearings take place (Nos. 1210, 1220 and 1230 of the GKG cost schedule).

Amount in dispute Fee 1.0 First instance (3.0) Appeal (4.0) Federal Court of Justice (5.0)
€1,000 €61.00 €183.00 €244.00 €305.00
€2,000 €103.00 €309.00 €412.00 €515.00
€5,000 €170.50 €511.50 €682.00 €852.50
€10,000 €283.00 €849.00 €1,132.00 €1,415.00
€20,000 €405.00 €1,215.00 €1,620.00 €2,025.00
€30,000 €476.00 €1,428.00 €1,904.00 €2,380.00
€50,000 €638.00 €1,914.00 €2,552.00 €3,190.00
€100,000 €1,198.00 €3,594.00 €4,792.00 €5,990.00
€200,000 €2,038.00 €6,114.00 €8,152.00 €10,190.00
€500,000 €4,138.00 €12,414.00 €16,552.00 €20,690.00
€1,000,000 €6,238.00 €18,714.00 €24,952.00 €31,190.00

Expenses can come on top, above all for witnesses and court-appointed experts. An expert opinion often costs more than the court fee itself.

When the court fee is reduced

In the first instance, the fee drops from 3.0 to 1.0 if the case ends without a contested judgment: by withdrawal of the action before the end of the oral hearing, by judgment on acknowledgment or by a court settlement (No. 1211 of the GKG cost schedule). With €50,000 in dispute, that is €638 instead of €1,914.

Advance on court fees

The claimant pays the court fee in advance. The court serves the claim on the defendant only once the advance has been paid (§ 12(1) GKG). If the claimant wins, the other side must reimburse it.

3. RVG Fee Table: Lawyer Fees in Germany by Amount in Dispute

This is what one lawyer costs in an ordinary first-instance lawsuit with an oral hearing:

Amount in dispute Procedural fee 1.3 Hearing fee 1.2 Total net (incl. €20 allowance) Total incl. 19% VAT
€1,000 €120.90 €111.60 €252.50 €300.47
€2,000 €228.80 €211.20 €460.00 €547.40
€5,000 €460.85 €425.40 €906.25 €1,078.44
€10,000 €847.60 €782.40 €1,650.00 €1,963.50
€20,000 €1,133.60 €1,046.40 €2,200.00 €2,618.00
€30,000 €1,316.90 €1,215.60 €2,552.50 €3,037.47
€50,000 €1,764.10 €1,628.40 €3,412.50 €4,060.88
€100,000 €2,281.50 €2,106.00 €4,407.50 €5,244.93
€200,000 €3,057.60 €2,822.40 €5,900.00 €7,021.00
€500,000 €4,877.60 €4,502.40 €9,400.00 €11,186.00
€1,000,000 €7,152.60 €6,602.40 €13,775.00 €16,392.25

If the parties settle, a settlement fee is added (1.0 in pending proceedings). With €10,000 in dispute, that is another €652 net.

4. The RVG Explained: How German Lawyers Charge

The RVG sets what lawyers in Germany may charge unless a different fee has been agreed. It has two parts: the act itself with the fee table (§ 13 RVG and Annex 2) and the fee schedule (Vergütungsverzeichnis, VV RVG, Annex 1). The fee schedule defines which fee applies to which work, and at what rate.

Value-based fees: amount in dispute × rate

Most lawyer fees are value-based. You take the basic fee for the amount in dispute from the table and multiply it by the rate from the fee schedule. Example: procedural fee 1.3 at €10,000 = 1.3 × €652 = €847.60. In criminal, regulatory-offence and many social-security cases, fixed fee ranges apply instead.

VV RVG: the main fees in the RVG fee schedule

No. VV RVG Fee Rate When it is charged
2300 Business fee (Geschäftsgebühr) 0.5 to 2.5, normally 1.3 Out-of-court representation, e.g. demand letters, negotiations
3100 Procedural fee (Verfahrensgebühr) 1.3 First-instance lawsuit, from the mandate
3101 Procedural fee (reduced) 0.8 Mandate ends before the claim is filed or before a hearing
3104 Hearing fee (Terminsgebühr) 1.2 Oral hearing, discussion or settlement talks
3105 Hearing fee (reduced) 0.5 Only a default judgment at the hearing
1000 Settlement fee (Einigungsgebühr) 1.5 Settlement without court proceedings
1003 Settlement fee 1.0 Settlement in pending first-instance proceedings
1004 Settlement fee 1.3 Settlement on appeal
1008 Increase + 0.3 per additional client, max. + 2.0 Several clients in the same matter
3200 / 3202 Procedural / hearing fee on appeal 1.6 / 1.2 Appeal (Berufung)
3208 / 3210 Procedural / hearing fee at the Federal Court of Justice 2.3 / 1.5 Appeal on points of law (Revision), only by a lawyer admitted at the BGH
3305 Procedural fee, payment order 1.0 Application for a court payment order (Mahnbescheid)
7002 Expenses allowance 20% of the fees, max. €20 Postage and telecommunications, per matter
7008 VAT 19% On all fees and expenses

Business fee for out-of-court work and how it is credited

If the lawyer first writes to the other side out of court, the business fee arises, normally at 1.3. The lawyer may charge more than 1.3 only if the matter was extensive or difficult. If a lawsuit follows, half of the business fee, at most 0.75, is credited against the procedural fee (Preliminary Note 3(4) VV RVG).

Example at €10,000: the business fee 1.3 is €847.60 (€867.60 net with the allowance). In the lawsuit that follows, the procedural fee of €847.60 is reduced by 0.65 × €652 = €423.80. In the end, the out-of-court work costs only half a fee extra.

Settlement fee

The settlement fee rewards the lawyer for ending a dispute by agreement. Without court proceedings it is 1.5, in pending proceedings 1.0, on appeal 1.3. Because the court fee drops at the same time, a first-instance settlement is often still cheaper than a judgment for both sides (see the example below).

Expenses and VAT

On top of the fees, lawyers charge expenses: the postage and telecommunications allowance (20% of the fees, at most €20), copies, travel costs and 19% VAT. If the other side is a business entitled to deduct input VAT, it is reimbursed only the net amounts when it wins.

Fee agreements, hourly rates and contingency fees

Lawyer and client can agree on a different fee, such as an hourly rate or a flat fee. The agreement must be made in text form (§ 3a RVG). In court proceedings it may not fall below the statutory fees (§ 4 RVG, § 49b BRAO). There is no statutory maximum hourly rate. The other side, however, only ever reimburses the statutory RVG fees, so an agreed fee above them stays with the client even after a win.

Contingency fees are allowed only in exceptional cases, for example for money claims up to €2,000 or if the client would otherwise be kept from pursuing the claim (§ 4a RVG).

Initial consultation

For a first consultation with a consumer, a lawyer may charge at most €190 net without a fee agreement, and at most €250 for further advice (§ 34 RVG).

The 2025 RVG increase: what changed

On 1 June 2025, the Costs and Guardian Remuneration Amendment Act (KostBRÄG 2025) raised the value-based RVG fees by around 6% and court fees by 6 to 9%. It was the first adjustment since 2021. For mandates given before 1 June 2025, the old table still applies (§ 60 RVG). [Check before publishing: no further adjustment adopted for 2027.]

5. Old RVG and GKG Tables 2021 (until 31 May 2025)

The old 2021 table has not disappeared completely. If the client instructed the lawyer before 1 June 2025, the lawyer still charges the old values (§ 60 RVG). For court fees, the old law applies if the proceedings were filed before 1 June 2025; an appeal filed after that date falls under the new table (§ 71 GKG).

The old values are from the version in force from 1 January 2021 to 31 May 2025 (KostRÄG 2021).

6. How Much Does a Lawsuit Cost in Germany? Cost Risk by Instance

Germany follows the loser-pays rule: whoever loses pays the court costs and both lawyers. The table shows this cost risk including VAT, without witness and expert costs:

Amount in dispute First instance Appeal Federal Court of Justice Total, 2 instances Total, 3 instances
€1,000 €783.95 €911.35 €1,193.69 €1,695.30 €2,888.99
€5,000 €2,668.38 €3,091.99 €4,106.20 €5,760.36 €9,866.56
€10,000 €4,776.00 €5,524.53 €7,359.29 €10,300.53 €17,659.82
€30,000 €7,502.95 €8,702.23 €11,589.17 €16,205.18 €27,794.35
€50,000 €10,035.75 €11,642.65 €15,510.31 €21,678.40 €37,188.71
€100,000 €14,083.85 €16,534.92 €21,909.82 €30,618.77 €52,528.59
€200,000 €20,156.00 €23,873.33 €31,509.09 €44,029.33 €75,538.42
€500,000 €34,786.00 €41,602.93 €54,670.69 €76,388.93 €131,059.62
€1,000,000 €51,498.50 €61,664.93 €80,997.69 €113,163.43 €194,161.12

Calculation: first instance = GKG 3.0 + per lawyer 2.5 fees + €20. Appeal = GKG 4.0 + per lawyer 1.6 + 1.2 + €20. Federal Court of Justice = GKG 5.0 + per BGH lawyer 2.3 + 1.5 + €20, each with 19% VAT on the lawyer fees.

Your own cost risk: the litigation cost calculator uses your amount in dispute and shows every instance.

Example at 10,000 euros: judgment, settlement or withdrawal

Outcome Court fees Lawyer fees Who pays what
Judgment, claimant loses €849.00 (3.0) 2 × €1,963.50 Claimant pays everything: €4,776.00
Settlement at the hearing, each side bears its own costs €283.00 (1.0) €2,739.38 per side (1.3 + 1.2 + 1.0 + €20, incl. VAT) Each side: own lawyer + half the court fee = €2,880.88
Claim withdrawn before the hearing €283.00 (1.0) 2 × €1,032.44 (procedural fee 1.3 + €20 only, incl. VAT) Claimant pays everything: €2,347.88

For the claimant, the settlement is around €1,900 cheaper than losing at judgment, but more expensive than winning, where the other side bears everything.

Example at 100,000 euros: two instances

A company sues for €100,000, loses at first instance and appeals, and loses again. The first instance costs €14,083.85, the appeal another €16,534.92. In total the claimant bears over €30,600 – almost a third of the amount claimed, before any expert costs.

7. Who Pays the Costs in a German Lawsuit?

The rule: loser pays

The losing party bears the costs of the proceedings, including the other side’s necessary lawyer fees (§ 91 ZPO). If each side wins in part, the costs are split in proportion (§ 92 ZPO). A party that recovers 60% of its claim usually bears 40% of the costs.

What happens if you lose a case and how to protect yourself is explained in Litigation funding: what happens if you lose?.

In a settlement

The parties decide in the settlement who bears which costs. If the settlement says nothing, each side bears its own costs (§ 98 ZPO): everyone pays their own lawyer, and the court costs are split.

Getting your costs back: the cost assessment application

After the judgment, the other side does not pay automatically. The winner files an application for assessment of costs (Kostenfestsetzungsantrag, §§ 103, 104 ZPO) with the first-instance court, listing its costs. The court fixes the amount in a cost assessment order, which can be enforced. The amount bears interest at 5 percentage points above the base rate from the date the application is received. An advance on court fees the winner paid is included.

8. How the Amount in Dispute Is Set

Every fee depends on the amount in dispute. In court proceedings it is called Streitwert, in the RVG Gegenstandswert; they usually mean the same.

Type of case Amount in dispute Legal basis
Payment claim the principal amount claimed, without interest and costs § 4 ZPO
Unfair dismissal claim three months’ gross salary § 42(2) GKG
Eviction action one year’s net rent § 41(2) GKG
Divorce three months’ net income of both spouses, at least €3,000 § 43 FamGKG
Injunctions, other claims court’s estimate of the claimant’s interest § 3 ZPO, § 48 GKG
Maximum 30 million euros § 39(2) GKG, § 22(2) RVG

9. Special Cases: Payment Order, Labour Court, Divorce

How much does a court payment order (Mahnbescheid) cost?

In the court’s summary payment procedure, half a court fee is charged (0.5), at least €38 (No. 1100 of the GKG cost schedule). If the creditor instructs a lawyer, a procedural fee of 1.0 arises (No. 3305 VV RVG).

Claim Court fee, payment order Lawyer (1.0 + allowance, net)
€1,000 €38.00 (minimum fee) €111.60
€5,000 €85.25 €374.50
€10,000 €141.50 €672.00

If the debtor objects and the matter goes to court, both fees are credited against the fees of the lawsuit.

Labour court

Before the labour court, the first-instance court fee is 2.0 instead of 3.0 (No. 8210 of the GKG cost schedule). It is waived entirely if the case ends in a court settlement, and no advance is required. Important: in the first instance, each side pays its own lawyer, even if it wins (§ 12a ArbGG).

Example, unfair dismissal claim with a gross salary of €4,000: amount in dispute €12,000, court fee €627 (waived on settlement), lawyer around €2,127 per side including VAT.

Family court and divorce

Family matters fall under the FamGKG, whose fee table matches the GKG table. A divorce carries 2.0 court fees (No. 1110 of the FamGKG cost schedule). Example with a combined net income of €4,000: value of the proceedings €12,000, court costs €627, lawyer around €2,127 including VAT. Pension rights adjustment increases the value.

10. Legal Aid: the § 49 RVG Fee Table

If you cannot afford the costs and your case has reasonable prospects of success, you can apply for legal aid (Prozesskostenhilfe, §§ 114 et seq. ZPO). The state then covers your own court and lawyer costs in full or in instalments. Legal aid does not cover the other side’s lawyer fees if you lose.

The lawyer assigned under legal aid is paid from the state treasury. Up to a value of €4,000, the fees are the same as in the normal RVG table; above that, the lower values of § 49 RVG apply. Above €80,000 they do not rise any further.

11. When the Cost Risk Is Too High

There are three ways to avoid bearing the costs of a lawsuit yourself. Our guide to litigation financing options compares them in detail.

  • Legal aid: for people on low incomes; it does not cover the other side’s costs if you lose.
  • Legal expenses insurance: pays if the policy existed before the dispute arose and the area of law is covered. See Litigation funding or legal expenses insurance.
  • Litigation funding: from an amount in dispute of around 100,000 euros – in mass claims also below – litigation funding is an option. The funder pays the court and lawyer fees and bears the entire cost risk if the case is lost, in the example above over 30,000 euros for two instances. Litigation funders on the market usually receive 20 to 40 percent of the amount recovered; at AEQUIFIN, the share is set for each case in a bidding process among sponsors (Quotenbalancing).

FAQ

What is the RVG fee table?

Reading Time: 12 minutes

The RVG fee table is the table in Annex 2 to § 13 of the German Lawyers’ Remuneration Act (RVG). For each amount in dispute it gives the basic lawyer fee, for example €652 at €10,000. Multiplied by the rate from the fee schedule, such as 1.3 for the procedural fee, it gives the actual fee. The current table has applied since 1 June 2025.

Does the 2025 RVG fee table still apply in 2026?

Reading Time: 12 minutes

Yes. The fees were raised on 1 June 2025 and have not changed since, so they also apply in 2026. The old 2021 RVG table only applies to mandates given before 1 June 2025 (§ 60 RVG). For court fees, what matters is whether the proceedings were filed before or after that date (§ 71 GKG).

How much does a lawsuit in Germany cost with 10,000 euros in dispute?

Reading Time: 12 minutes

The first instance costs €849 in court fees. Each lawyer receives €1,650 net, or €1,963.50 including VAT. The losing party pays the court, its own lawyer and the other side’s lawyer: around €4,776 in total. If the case ends in a settlement, the court fee drops to €283.

How are lawyer fees calculated under the RVG?

Reading Time: 12 minutes

Take the basic fee for the amount in dispute from the RVG table and multiply it by the rates that apply: in a lawsuit usually 1.3 for the procedural fee and 1.2 for the hearing fee. Add the expenses allowance (at most €20) and 19% VAT. At €30,000, that comes to €3,037.47 including VAT.

Who pays the legal fees if I lose a case in Germany?

Reading Time: 12 minutes

You do. Under § 91 ZPO, the losing party pays the court costs and the necessary lawyer fees of both sides, up to the statutory RVG fees. If you win in part, the costs are split in proportion. The labour court is an exception: in the first instance, each side pays its own lawyer.

Who pays the court costs in a settlement?

Reading Time: 12 minutes

The parties agree on this in the settlement. If it says nothing, each side bears its own costs under § 98 ZPO: everyone pays their own lawyer and the court costs are split. The first-instance court fee drops from 3.0 to 1.0; before the labour court it is waived entirely.

How much does a court payment order (Mahnbescheid) cost?

Reading Time: 12 minutes

The court charges a 0.5 fee, at least €38. For a €5,000 claim that is €85.25, for €10,000 it is €141.50. With a lawyer, a 1.0 procedural fee is added, €374.50 net at €5,000. If the claim was justified, the debtor bears these costs in the end.

From what amount in dispute is litigation funding worth it?

Reading Time: 12 minutes

Usually from around 100,000 euros, in mass claims also below. At that level the cost risk is over 14,000 euros in the first instance alone and over 30,000 euros across two instances. The litigation funder bears this risk and receives a share of the proceeds only if the case is won.
