Second round of pilot proceedings before oral hearing

Case Update “Participation in the insolvency estate of Wirecard AG”


 

Can shareholders claim their damages in the insolvency proceedings of Wirecard AG? This fundamental question is currently being disputed before the Munich Higher Regional Court. The fund company Union Investment has sued the insolvency administrator of Wirecard AG, Michael Jaffé, for EUR 243 million.

The outcome of these pilot proceedings will determine whether the other aggrieved Wirecard shareholders also have a fundamental claim to compensation from the insolvency estate.

The plaintiff lost the first instance at Munich Regional Court I. An oral hearing has now been scheduled for July 16 in the ongoing appeal proceedings. However, trial observers agree: regardless of how the Higher Regional Court rules, a final decision will probably ultimately be made by the Federal Supreme Court.

Injured shareholders - and with them the sponsors of the AEQUIFIN platform - will therefore have to be patient until there is clarity about their claims against the insolvency administrator.
